End User License Agreement (EULA) for Polygon Art Games

1. Acceptance of Terms

By downloading, installing, or playing our games, you accept and agree to be bound by the terms of this EULA and our Privacy Policy. If you do not agree to these terms, you must not use our games.

2. License Grant

Polygon Art grants you a non-exclusive, non-transferable, revocable license to use our games for your personal, non-commercial purposes. This license does not grant you any ownership rights in the game or its content.

3. Age Restrictions

Our games are designed for a wide range of ages. Users are responsible for adhering to age ratings and ensuring that their game use complies with local laws regarding age-specific content.

4. User-Generated Content (UGC)

By creating content, you grant Polygon Art a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, display, distribute, and monetize such content for promotional or commercial purposes. If we choose to monetize your content, we may, at our discretion, offer you compensation.

Polygon Art reserves the right to modify, suspend, or discontinue the game or any part of it without prior notice. We may terminate your access to the game if you breach this EULA. Upon termination, your license to use the game will be revoked.

7. Disclaimer of Warranties

The game is provided "as is" and "as available," without any warranties of any kind, either express or implied. Polygon Art does not warrant that the game will be uninterrupted or error-free.

8. Limitation of Liability

Polygon Art will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the game.

9. Governing Law

This EULA is governed by the laws of Germany, without regard to its conflict of law provisions.

10. Dispute Resolution

Any disputes arising from this EULA will be resolved through final and binding arbitration under the Rules of Arbitration of the International Chamber of Commerce. The arbitration will take place in Germany, and the language of the arbitration shall be English.

11. General Provisions

This EULA constitutes the entire agreement between you and Polygon Art regarding our games. If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
